Federal Judge in Texas Rules That DACA Program is Totally Illegal

A federal judge in Texas ruled that Obama’s DACA program is totally illegal and that no one can become classified as DACA from this point on, although he did not rule that current DACA recipients could be removed from the program:

A federal judge in Texas again ruled unlawful on Wednesday a program that has shielded hundreds of thousands of undocumented young adults from deportation and allowed them to legally work in the United States, rejecting a new rule that the Biden administration had introduced to address the court’s concerns.

The decision will prevent new applicants from applying for the program, but will not affect current applicants:

The decision is the latest twist in a five-year-long court saga that has left the program and its beneficiaries, known as Dreamers, hanging in the balance. While the ruling is a blow to the immigrants, the judge did not mandate an immediate end to the program. Current applicants will be able to keep and renew their protection. No new applications will be allowed.

“There are no material differences between the two programs,” the judge wrote in his 40-page opinion, adding that his decision did not compel the government to “take any immigration, deportation or criminal action against any DACA recipient.”

Biden had been pushing to codify Obama’s illegal DACA immigration policies, which would allow many illegals to GET PAID TAXPAYER DOLLARS VIA SOCIAL SECURITY AND MEDICARE while receiving other benefits.

In a suit brought by Texas Attorney General @KenPaxtonTX, these particular illegal immigrants impose on the the state of Texas (aka the TAXPAYER) a cost of more than $250,000,000 per year and another $533,000,000 annually in costs to local Texas communities.

 A federal judge on Wednesday declared illegal a revised version of a federal policy that prevents the deportation of hundreds of thousands of immigrants brought to the U.S. as children.

U.S. District Judge Andrew Hanen agreed with Texas and eight other states suing to stop the Deferred Action for Childhood Arrivals, or DACA, program. The judge’s ruling was ultimately expected to be appealed to the U.S. Supreme Court, sending the program’s fate before the high court for a third time.

Hanen barred the government from approving any new applications, but left the program intact for existing recipients during the expected appeals process. Hanen said his order does not require the federal government to take any actions against DACA recipients.

The states have argued the Obama administration didn’t have the authority to first create the program in 2012 because it circumvented Congress.

In 2021, Hanen had declared the program illegal, ruling it had not been subject to public notice and comment periods required under the federal Administrative Procedures Act.

Biden will appeal this ruling and then he will try to get the case heard by a liberal activist judge.
